Welcome to Perseverance Academy™, a biblically grounded mental health education platform operated by Perseverance Counseling & Consulting, LLC ("the Organization"). By accessing or using this website and its content, you agree to be bound by the following Terms of Use. If you do not agree to these terms, please discontinue use immediately.


1. EDUCATIONAL DISCLAIMER

The content provided through Perseverance Academy™, Perseverance Counseling & Consulting, LLC, and The Perseverance Model™ — including all written materials, digital resources, virtual training sessions, webinars, and course content — is intended solely for educational and informational purposes. It does not constitute therapy, counseling, psychological treatment, or medical advice, and does not establish a therapist-client relationship.

Information presented herein integrates biblical narratives with clinical educational concepts drawn from the Diagnostic and Statistical Manual of Mental Disorders, Fifth Edition, Text Revision (DSM-5-TR), or its most current edition at the time of instruction, for purposes of reducing mental health stigma across diverse communities. Perseverance Academy™ is committed to updating course content as new editions and clinical revisions are released to ensure alignment with current mental health standards. Individuals experiencing a mental health crisis or requiring clinical intervention are strongly encouraged to seek care from a licensed mental health professional. 2. PRIVACY POLICY

A. Information Collected The platform may collect the following categories of information from participants and users: identifiers such as name, email address, mailing address, phone number, and account credentials; transactional data including registration records, course enrollment history, and payment information; educational data such as program participation and completion records; voluntary data including survey responses and ministry care inquiries; and technical data such as IP address, browser type, device identifiers, and session activity.

B. Purpose of Collection Personal information is collected solely to facilitate educational programming, course administration, ministry communications, and the improvement of platform services. Information will not be sold or used for commercial advertising.

C. Data Sharing Personal data may be shared with trusted third-party service providers — including learning management systems, payment processors, and communication platforms — solely as necessary to deliver services. All third parties are required to maintain confidentiality consistent with applicable law. Data will not be disclosed to external parties for marketing or unrelated purposes without express consent.

D. User Rights Participants may request access to, correction of, or deletion of their personal information at any time by contacting us at info@theperseveranceacademy.com. Requests will be honored in accordance with applicable privacy law, including the Texas Data Privacy and Security Act.

E. Data Security Reasonable administrative, technical, and physical safeguards are implemented to protect personal information from unauthorized access, disclosure, or misuse. No method of electronic transmission is entirely secure; users provide information at their own risk.

F. Minors This platform is not intended for use by individuals under the age of thirteen (13). No personal information will be knowingly collected from minors. Parents or guardians who believe a minor has submitted personal data are encouraged to contact us immediately at info@theperseveranceacademy.com for prompt deletion.


3. TERMS OF USE

A. Acceptance By accessing or using this platform and its content, users enter into a binding agreement with Perseverance Counseling & Consulting, LLC. Users who do not agree to these terms should discontinue use immediately.

B. Intellectual Property All content — including but not limited to the DTI-BB-MHE™ framework, The Perseverance Model™, Perseverance Academy™, curriculum materials, written resources, course recordings, and digital publications — is the exclusive intellectual property of Perseverance Counseling & Consulting, LLC and is protected by applicable copyright and trademark law, including active USPTO trademark registrations. Users are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use only. No content may be reproduced, redistributed, sold, adapted, incorporated into artificial intelligence systems, or used for commercial purposes without prior written authorization.

C. Acceptable Use Users agree to access and engage with platform content in a manner consistent with its educational purpose. Prohibited conduct includes unauthorized scraping or copying of content; submission of false, defamatory, or harmful materials; impersonation of other users; interference with platform functionality; uploading of malware or disruptive files; and use of content in connection with AI training datasets or generative AI tools.

D. Refund Policy All sales are final. Perseverance Academy™ does not offer refunds on any digital course or bundle purchase. By completing your purchase you acknowledge that you have reviewed the course description and that no refund will be issued after access has been granted.

Technical Access Exception: If you experience a verified technical error that prevents access to purchased course content, you must notify us in writing within 72 hours of purchase at info@theperseveranceacademy.com. We will make reasonable efforts to resolve the technical issue. If the issue cannot be resolved within 7 business days, a course credit or exchange of equal value may be offered at our sole discretion. No cash refunds will be issued under any circumstances.

E. Limitation of Liability Perseverance Counseling & Consulting, LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, this platform or its content. All content is provided on an "as is" basis without warranties of any kind. The Organization's total liability for any claim arising from platform use shall not exceed the amount paid by the user for the specific course or service giving rise to the claim.

F. Dispute Resolution Any dispute arising from or related to the use of this platform shall first be submitted to the Organization in writing for good-faith resolution. Unresolved disputes will be subject to binding arbitration in accordance with applicable Texas law. Users waive the right to participate in class action proceedings. All legal matters shall be governed by the laws of the State of Texas.

G. Modifications The Organization reserves the right to modify these terms at any time. Continued use of the platform following the posting of updated terms constitutes acceptance of the changes.


4. NONDISCLOSURE

Participants in any program, course, training session, webinar, or activity operating under the DTI-BB-MHE™ framework may be asked to execute a nondisclosure agreement. The following core provisions apply:

Participants agree not to disclose proprietary content, framework methodologies, unpublished curriculum, research data, or any materials shared in closed training sessions. Confidentiality obligations remain in effect during participation and for a minimum of two (2) years following the conclusion of any program engagement. Information already in the public domain, independently developed by the participant, or required to be disclosed by law is not subject to these restrictions. Unauthorized disclosure of confidential information may cause irreparable harm; the Organization reserves the right to seek injunctive relief and all available legal remedies in the event of a breach.


5. HOLD HARMLESS AGREEMENT

By registering for and/or participating in any program, course, training session, webinar, or activity offered through Perseverance Counseling & Consulting, LLC or its affiliated entities, participants agree to release, indemnify, and hold harmless Perseverance Counseling & Consulting, LLC, Perseverance Academy™, and their respective officers, agents, facilitators, and representatives from and against any and all claims, damages, losses, or liabilities arising out of or related to participation in such programs.

Participants acknowledge that all content is provided for educational purposes only and does not constitute professional clinical services. Participants assume full responsibility for any decisions made based upon information received through these programs.

This agreement does not limit any rights participants may have under applicable consumer protection or professional licensing laws.


6. GOVERNING LAW

These Terms of Use are governed by and construed in accordance with the laws of the State of Texas and applicable federal law, including the ethical standards governing licensed professional counselors in the State of Texas.
